California is one of the few states in the nation that is a "non-rider" health insurance state. California medical insurance regulations states that an insurance company offering health insurance in California is not permitted to place an "exclusionary rider" on a new health insurance policy. Consequently, the acceptance guidelines of the insurance companies in this state tend to be stricter than in other states, with a higher percentage of declined applications. Note, rates for individuals in California are based only on geographical location and age. Health Insurance companies offering (individual or family) California health insurance plans may deny coverage based on medical history and other factors.
Federal law stretches certain protections to small businesses seeking to buy health insurance in California for themselves and their workers. California has enacted reforms to expand some of these protections. In fact, small businesses are those that employ 2-50 employees. Note, however, that the definitions of small business and employee are somewhat different under federal and state law. It is recommended to check with the California Department of Insurance or the Department of Managed Health Care to be sure that you know which protections apply to your group. If you have a small business in California, you can be charged higher premiums within limits because someone in your group is seriously ill. Besides, you can also be charged somewhat more due to the age and family size of those in your group and where your small business is located. California does not limit premium variation or increases for groups with more than fifty employees. Small businesses are guaranteed issue and cannot be turned down, with few exceptions. Your California group health insurance is guaranteed renewable and cannot be canceled because someone in your group becomes sick.
